Filed 22nd February, 2008 by Deborah M. Sykes, Court Reporter.

Plantiff: Hobbes D. Erminius
Represented by Allehandro Willisimo, Esq.

Respondant: Chief of Police Mark Lippold

1 Alleged, that Respondant did on the night of Febrary 22nd enter the 7-11 at which Plantiff is a security clerk;

2 that Respondant did in full knowledge of the illegality of his actions sieze cans of soda having a worth of twenty-five dollars;

3 that Respondant did exit the store with said sodas, ignoring the complaints of the Plantiff who attempted to prevent this action as per her duty;

4 that Repondant did at a later time refute attempts on the part of the Plantiff to redress this greivance, saying, "I didn't see a name on it."

5 that as a result of the Respondants actions, Plantiff was robbed of two hundred dollars, which is the amount Plantiff now claims.

The total retail value of said cans of soda is $25.00, yet I am being sued for the amount of $200.00.

Plantiff claims she suffered 175 dollars worth of damadge, due to loss of consumer confidence and stress, ect.

Her duties as gaurd include customer relations, and the welfare of the store is certainly part of her concern.

The customers lost confidence in the 7-11 in general, which harms the livelihood of my client.

(( Oh, as I see it, it would be. Seeing as I would just ingnore it afterwards. As it is its a frivialous lawsuit and a waste of everyones time. There's no jury/jugde to decide the case, proper filling procedures were passed and was filed before informing me of such action, thus giving me no time to prepare my argument.))

(( Regardless of all that and what kingofthemat just said, I still don't see a defendant simply throwing out a case because it's unfair or a waste of time, even as the Chief. Perhaps I am wrong. ))

(( I'm not throwing the case out, I was stating I would consider the case dead it if the prosecution fails to make a counter argument in a reasonable amount of time.
